1.1 Except as defined in this Schedule 13 (Broadband Services), capitalised terms shall have the meanings given to them in the Agreement.
1.2 To the extent applicable to the Broadband Services, in the event of conflict between the terms of this Schedule 13 and the Agreement, the provisions of this Schedule 13 shall take precedence, and in the event of conflict with a Service Document, Statement of Work, or Service Order, the provisions of that Service Document shall take precedence over this Schedule 13.
1.3 This Schedule 13 applies to the supply of Broadband Services (xDSL, SoGEA, FTTC, G.Fast and FTTP) by M-Tech Systems Ltd. It does not apply to Ethernet or Leased Line Connectivity Services (see Schedule 12) or Telephony Services (see Schedule 5).
“Act” means the Communications Act 2003 and any amendments or replacements made from time to time.
“Acceptable Use Policies” means the policies set out on our Website relating to the use of the Services, as modified or amended from time to time.
“Account” means your account with us for provision of the Services.
“ADSL” means Broadband Services delivered over the copper wire telephone network. ADSL covers both ADSL and ADSL2+.
“Agreement” means the Agreement between the Customer and M-Tech Systems Ltd subject to these Terms and Conditions, Acceptable Use Policies, Price List, and Privacy Policy, all of which together constitute the Agreement between us and you for the supply of Services and/or Equipment.
“Broadband Services” means the broadband services supplied by M-Tech Systems Ltd, including (but not limited to) ADSL, FTTC, SoGEA, G.Fast, FTTP, or equivalent services provided over third-party networks such as those operated by Openreach, CityFibre, Lightning Fibre or other alternative network operators (“Altnets”).
“Business Customer” means a Customer who uses the Services and/or Equipment in the course of any trade or business.
“Charges” means the charges payable by you in return for the Services and/or Equipment in accordance with Clause 19.
“Company” means M-Tech Systems Ltd (Company Registration Number 04843249) of Martello House, Edward Road, Eastbourne, East Sussex, BN23 8AS.
“Customer” means the person, group of persons or other entity whose name and address is or are set out in the Order or the Sales Order Form.
“Customer Order” means the order for the supply of Services and/or Equipment by us, completed by, or in accordance with an order from, you.
“Equipment” means the physical equipment/goods specified in the Order or the Sales Order Form.
“FTTC Service” means Fibre to the Cabinet Service which provides a fibre optic connection to the Internet from the local exchange to your local street cabinet and a copper connection from the street cabinet to your Premises.
“FTTP Service” means the Fibre to the Premises Service which provides an end-to-end fibre optic connection to the Internet from the local exchange to your Premises.
